These terms are intended to explain the buying process clearly. They do not remove or limit any rights you have under applicable law.
1. What We Buy
GearCashOut buys selected drones, cameras, action cameras, lenses, video equipment, audio equipment and related accessories.
The equipment eligible for an instant quotation may change from time to time. Equipment not covered by the instant-quote system may be considered for a manual valuation.
2. Valuations and Instant Quotes
An instant quote is calculated using the information you provide, together with the valuation rules applicable to the equipment at the time the quote is generated.
An instant quote is not a guarantee that the equipment will ultimately be purchased for that amount. The equipment must be received and inspected before the final purchase price is confirmed.
You must provide accurate and complete information about the equipment, including its model, condition, accessories, faults and any other information requested during the valuation process.
3. Manual Valuations
Where an item is not supported by an instant quotation, GearCashOut may request additional information or photographs and provide a manual valuation.
A manual valuation is also subject to inspection and verification unless we expressly confirm otherwise.
4. Inspection and Verification
When equipment is received, we may inspect and test it to verify the information supplied during the valuation process.
Depending on the equipment, checks may include model, serial number, functionality, condition, damage, accessories, battery condition or cycle count, usage information, account or activation status and package contents.
For DJI drones, we may also check relevant flight information and whether the drone is unbound from the seller's DJI account.
5. Revised Offers
If the equipment differs materially from the information supplied, or if inspection identifies a fault, missing item or other factor that affects its value, we may make a revised offer.
Where a revised offer is made, you will be given the opportunity to accept or reject it before the transaction is completed.
If you reject a revised offer, we will arrange for the equipment to be returned to the return address you supplied, subject to any applicable delivery arrangements communicated to you.
6. Ownership and Right to Sell
You must have the legal right to sell the equipment to us. By submitting equipment, you confirm that it is yours to sell or that you have authority from the owner to sell it.
You must not submit stolen, lost, counterfeit or unlawfully obtained equipment, or equipment that is subject to a finance, lease or other restriction preventing its sale.
We may check serial numbers or other identifying information where reasonably necessary to verify ownership or the status of equipment.
If ownership is uncertain, we may pause or refuse the transaction and may request reasonable evidence of ownership.
7. Condition and Disclosure
You must disclose known faults, damage, modifications and other material issues that could affect the value or safe operation of the equipment.
Missing components, accessories or original packaging may affect the valuation where they form part of the quoted package.
Submitting photographs does not replace our right to inspect the equipment when received.
8. Account, Activation and Security Status
Where applicable, equipment must be capable of lawful transfer to us. For DJI drones, this may include removing the equipment from the seller's DJI account and providing evidence of an unbound status when requested.
You must not provide us with passwords, authentication codes or other security credentials unless specifically requested through a secure and appropriate process. We will not ask you to disclose your personal account password as part of a normal valuation.
9. Sending Equipment to Us
After accepting an offer, you will be given instructions for sending or otherwise delivering the equipment to us.
You are responsible for following the provided packaging and shipping instructions. Where a specific shipping service or label is provided, you should use it as instructed.
You should retain any tracking information or proof of dispatch until the equipment has been received and the transaction has been completed.
10. Equipment Received by Us
We will use reasonable care while equipment is in our possession. If there is an issue with equipment received, we will contact you where reasonably possible and explain the next step.
We may refuse to complete a transaction where the equipment received is materially different from the equipment described, cannot lawfully be purchased, or presents another material issue that prevents the transaction from proceeding.
11. Payment
Payment will be made using the payment method and details confirmed during the buying process after the final purchase price has been accepted and the required verification checks have been completed.
You are responsible for providing accurate payment details. We are not responsible for delays caused by incorrect or incomplete payment information supplied by you.
12. Returning Equipment
If a revised offer is rejected, or if we are unable to complete the purchase for another stated reason, we will arrange return of the equipment to the return address supplied by you, subject to the applicable return arrangements.
You are responsible for ensuring that the return address is complete and accurate.
13. Personal Information
We collect and use personal information in accordance with our Privacy Policy.
You should not include unnecessary personal information in photographs or documents submitted for valuation.
14. Website Information
We aim to keep information on this website accurate and up to date. Equipment categories, valuation availability and buying criteria may change as the service develops.
Nothing on the website creates a guarantee that a particular item will be purchased or that a particular valuation will be available unless we have expressly confirmed an offer to you.
15. Our Legal Responsibilities
Nothing in these terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited.
These terms are not intended to exclude responsibility for matters such as death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that the law does not permit us to exclude.
16. Complaints
If you have a complaint about the valuation, inspection, payment, return or any other part of the service, please contact us using the details on our Contact page. We will review the matter and respond as reasonably promptly as possible.
17. Changes to These Terms
We may update these terms when the service changes or where necessary to reflect legal or operational requirements. The version applying to a transaction will be the version that was made available to you when you entered into that transaction.
18. Governing Law
These terms are governed by the law of England and Wales, unless applicable law requires otherwise. Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have under applicable law.
